Welcome to the use of our app! We attach great importance to protecting your personal data and safeguarding your privacy. We would like to explain below which data is processed when, for what purpose and on what legal basis. The aim is to explain how our product and the services we offer work and how the protection of your personal data is guaranteed. The privacy policy can be accessed at any time at www.sorel.de.
Insofar as we cite our legitimate interest or a legitimate interest of a third party (Art. 6 para. 1 lit. f) GDPR) as the legal basis for the processing of personal data, you have the right to object in accordance with Art. 21 GDPR:

We provide you with a mobile app that you can download to your (mobile) device (iOS, Android). Below we provide information about the collection of personal data when using our products.
According to Art. 4 (1) GDPR, personal data means any information relating to an identified or identifiable natural person. An identifiable natural person is one who can be identified, directly or indirectly. Further information on this can be found in Art. 4 No. 1 GDPR.
If we use contracted service providers for individual functions of our products or would like to use your data for advertising purposes, we will inform you in detail below about the respective processes. In doing so, we will also state the defined criteria for the storage period.
In addition to the purely informational use of our products, we offer various services that you can use if you are interested. To do so, you must generally provide further personal data that we use to provide the respective service and for which the aforementioned data processing principles apply.

When you use our app, we automatically collect certain technical data in log files. This data is required to ensure the security and stability of our systems and to optimize our services. The information collected includes in particular

When you download our mobile app, the respective app store of your device operating system processes certain data, such as your user name, your email address or your payment information. We have no influence on this data processing and are not responsible for it.

We ourselves only receive the information that is necessary for the provision and administration of the app.
Within the app, we process additional device identifiers to enable the use of the app and to provide certain functions.
After installing the app, you can register for your user account by entering your e-mail address and freely assigning a password. You will then receive a confirmation email with an activation link. Once you have clicked on the activation link and the user account has been activated, you can connect your mobile device to the heating system via the app by entering the device ID.

The recipient of the data is our server host, who works for us as part of a contract data agreement. The server is currently operated by Hetzner Online GmbH. The server is located in the European Union, currently Finland. For the purpose of ensuring backups, the data is also stored on other servers of the server host within the European Union.

The legal basis for the processing of this data for the purpose of analyzing the data to collect average performance data and using it for derived marketing purposes such as the training of AI models by the provider is Art. 6 lit. a) GDPR. By installing the app, you voluntarily consent to the processing of your personal data by the provider.
If you do not consent, data processing will be limited to what is absolutely necessary. The legal basis for this is Art. 6 lit. f) GDPR. It is not possible to provide the app services without processing the minimum required data.
The manufacturer also bases the processing of the personal data provided for the purpose of optimization and troubleshooting on a legitimate interest in accordance with Art. 6 lit. f) GDPR (following under point 9 of this data protection notice).
You have the right to object. You can send or inform us of your objection at any time (e.g. by e-mail to privacy@sorel.de).
We pursue the legitimate interest of ensuring the proper functioning of the products, detecting and rectifying errors at an early stage and continuously improving the products by evaluating aggregated usage data. This also protects your interests in safe, efficient and durable products.
Processing is limited to the data required for the stated purposes. The data is transmitted via secure connections and evaluated pseudonymized or aggregated as far as possible.
An impairment of the rights and freedoms of the data subjects therefore appears to be minimal. Taking into account the principle of data minimization, the implemented security measures (e.g. encryption, access restriction) and the possibility for you to object to the processing in accordance with Art. 21 GDPR, our legitimate interests outweigh your interests or fundamental rights and freedoms.

The original equipment manufacturers, system manufacturers and our sales partners/manufacturers of the heating system as well as the authorized craftsmen who install the heating system at your premises are responsible for the processing operations in other respects and for the purposes of the original equipment manufacturers, system manufacturers and our sales partners/manufacturers of the heating system.
For example, when installing the app for the end customer, the technicians, as data controllers, are obliged to comply with the provisions of the GDPR and to obtain the end customer's consent in advance in accordance with Art. 6 para. 1 a) GDPR.
The original equipment manufacturers, system manufacturers and our sales partners/manufacturers of the heating system are given access to the collected and processed personal data as administrators, analysts or support. Administrators and analysts can access the aggregated data of all their systems. This access serves:

If you do not consent, the processing of personal data is limited to the analysis of the data for the purpose of troubleshooting and system optimization. This processing is carried out on the basis of a legitimate interest pursuant to Art. 6 para. 1 lit. f) GDPR (see section 9 of this privacy policy).

Insofar as we act in this context with the services provided by the described third parties in the sense of order processing in accordance with Art. 28 GDPR, i.e. we process personal data for which the described third parties are responsible within the meaning of data protection law on behalf of the third parties in accordance with their instructions, the statutory provisions on order processing apply between us and the described third parties. In this respect, reference is made to the conditions of a contract for the commissioned processing of personal data to be agreed separately between us and the third parties.
We use technical and organizational measures to protect our systems against loss, destruction, access, modification or dissemination of data by unauthorized persons. Despite regular checks, however, complete protection against all risks is not possible.
